Za pomocą tego formularza można złożyć skargę na właściwy organ krajowy.
Uwaga:
Pola oznaczone opisem „
pole wymagane
” są obowiązkowe. Jeśli nie zostaną wypełnione, nie będzie można złożyć skargi.
Przed wypełnieniem formularza należy wziąć pod uwagę, że działania podjęte przez ESMA w reakcji na skargę prawdopodobnie nie rozstrzygną sytuacji osobistej skarżącego, np. nie doprowadzą do płatności rekompensaty lub odszkodowania. Cel postępowania wyjaśniającego w sprawie naruszenia prawa Unii ma charakter ogólny, tj. ma zapewnić, aby prowadzone dalej praktyki danego właściwego organu krajowego w pełni dostosowano do prawa UE. Należy również pamiętać, że ESMA nie ma obowiązku wszczęcia postępowania wyjaśniającego w sprawie naruszenia prawa Unii na podstawie art. 17 rozporządzenia w sprawie ESMA, nawet jeśli uzna, że naruszenie miało miejsce.
Aby bezpośrednio rozwiązać swoją sytuację osobistą lub uzyskać odszkodowanie, należy podjąć działania na szczeblu lokalnym, w państwie członkowskim, którego dotyczy skarga. Złożenie skargi do ESMA nie zawiesza terminów wszczęcia działań prawnych na podstawie prawa krajowego.
